1. THE DIGITAL SCHOOL COMMITMENT

1.1. We, The DIGITAL SCHOOL, provide and manage The Digital Educator’s Global Academy (DEGA) learning platform (our Services).

1.2. Our Services offer opportunities to interact with you in many different ways and when we interact with you, we may collect information from you including personal data.  You trust us to look after that information and we are committed to protecting your rights and your privacy.

1.3. When we refer to The DIGITAL SCHOOL, we, us and our, we mean The Digital School, a non-profit charity organization, duly established under the laws of Dubai, and registered by the Islamic Affairs Charitable Activities Department under Practice License number A99, having its principal address at 49th floor, Emirates Towers, Sheikh Zayed Road, P.O. Box 211100, Dubai, United Arab Emirates.

1.4. When we refer to user, your and you, we mean users of our Services or minors on behalf of whom you submit Personal Data.

2.1. This Privacy Policy apply to your use of our Services.

2.2. When we refer to Personal Data, we mean any information about an individual from which that person can be identified. It does not include data where the identity has been removed, which is referred to as anonymous data.

2.3. This Privacy Policy explains how we collect, store, process and use your Personal Data as part of our Services. It also describes the choices available to you regarding our use of your Personal Data and how you can access and update your Personal Data.

2.4. This Privacy Policy is in accordance with Federal Decree – Law No. 45/2021 on the Protection of Personal Data (the ‘Data Protection Legislation’).

4.1. We may collect and process the following Personal Data or other information about you in electronic and/or physical form:

    1. If you are interested in enrolling and/or registering into one of our initiatives, the following information below may be submitted by you and collected:

      1. Your personal information such as names; title; postal address; email address; phone number; dates of birth; gender; occupation information; government issued ID information; visa information; religious beliefs; etc.;

      2. Admissions and enrollment information, including your professional information including educational background, course enrollments and completions in addition to assessment and attainment data;

      3. Information about your computer, including where available the IP address of your computer/proxy server that you use to access the internet, your web browser type, type of mobile device, and computer operating system, to analyze trends among our users and to help improve the platform.

5. CONSENT

5.1. By submitting information to us, you consent to our collection, storing and processing of your information in accordance with this Privacy Policy. You are entitled to request that we stop any consent-based processing of your personal information after you withdraw that consent.

5.2. You are entitled to ask us not to process your personal information for marketing purposes.

6. HOW WE USE YOUR PERSONAL DATA

6.1. We will use the information you provide to/ in the following ways for the following purposes:

    1. To register and respond to your application

    2. To provide you with the services and functionality offered through the platform and to fulfill your requests, including, but not limited, to communicating with you about your enquiry or use of the Site, services, or functionality.

    3. To respond to, or follow up on, your comments and questions, and otherwise provide customer service.

    4. To operate and improve the Site, services, and functionality and tailor your experience on the Site, including search results and displaying relevant promotions.

    5. To ensure that the Site is presented in the most effective manner for you and for your computer.

    6. To provide you with information, products or services that you request from us or which we feel may interest you, based on information we collect from cookies or where you have consented to be contacted for such purposes.

    7. To chat with you or respond to your inquiries via email or contact forms on our website;

    8. To occasionally carry out surveys to ensure that we are providing you with what you are interested in.

    10. To protect, investigate and deter against fraudulent, unauthorized, or illegal activity, including as we feel is necessary to protect our interest.

6.2. We also may use the information in other ways for which we provide specific notice at the time of collection. The information collected is necessary for the purposes set forth above. Without this information, you may not be able to take advantage of some of our Services.

6.3. We have set out below the legal basis for our use of your Personal Data. We will use the information you provide for the above purposes if:

    1. It is necessary to perform a contract to which you are party (e.g., to process your payment and deliver the products you have ordered); or

    2. We have obtained your consent.

6.4. Such information will only be shared, in accordance with clause 6.3 above, only if:

    1. You specifically request this, such as when you submit information to enquire about your enrollment at a relevant initiative.

    2. We are required to do so to comply with our internal policies and procedures or the law, or with direction from the courts or other authorities.

    3. We feel it is reasonably necessary to prevent illegal activity or to protect our interests, such as when someone has breached the Website Terms of Use.

    4. We appoint consultants, experts and other advisors to assist the DIGITAL SCHOOL in fulfilling its obligations and need to share your information with them if it is relevant to their work.

    5. It helps our trusted third-party service providers to provide and improve our service to you or to carry out surveys and user analysis to understand your needs and preferences. We will also share your information with mass mail service provider, who securely hosts emails and acts as a supplier to distribute our newsletters. We require these service providers to keep your personal information safe and secure. These trusted third parties would only be permitted to use your personal information for the purposes we specify.

    6. We may also share your information with the Digital School affiliates.

    7. We won’t rent or sell your Personal Data to any other organization or individual. We may share some broader statistics and customer profiling information with third parties, but we’ll keep it anonymous, so you won’t be identifiable from that data.

7. YOUR DATA PROTECTION RIGHTS AND CHOICES

7.1. You have certain rights and choices in connection with the personal data we collect from you. 

7.2. Withdrawing Consent – You may also withdraw any consent you previously provided to us at any time with effect for the future by contacting us, where such withdrawal shall not affect the lawfulness of our use of your information based on your consent before its withdrawal.

7.3. Subject to Data Protection Legislation, you have the right to request access to and correction or erasure of the Personal Data we maintain about you, or to request the restriction of our use of this information, as appropriate. You also have the right to object at any time to the use of your Personal Data for direct marketing purposes, including profiling related to direct marketing. For all other purposes, you may object at any time to the use of your Personal Data, on grounds relating to your particular situation, in accordance with Data Protection Legislation. These rights may be limited in some circumstances under Data Protection Legislation. We may take reasonable steps to verify your identity before granting access or making corrections. You may exercise these rights by contacting us as indicated below.

7.4. Subject to Data Protection Legislation, you have the right to receive, in a structured and machine-readable format, the Personal Data that you have provided to us about you, with your consent or based on a contract to which you are party. You also have the right to have this information transmitted to another data controller, where it is technically feasible.

7.5. We may request proof of your identity before we disclose such information to you. That’s so we can prevent unauthorized access.

8. OTHER IMPORTANT INFORMATION

8.1. Data Transfers

    1. We do not disclose Personal Data we collect about you, except as described here. We may share your personal data with:

      1. Service providers who perform services on our behalf based on our instructions. We do not authorize these service providers to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements. Examples of these service providers include entities that provide web hosting and payment service providers; and.

      2. Other third parties with your consent.

    2. When we transfer your information to other countries, we will protect that information in the manner described in this Privacy Policy and applicable data protection laws. We have also implemented appropriate safeguards to ensure such a level of data protection when transferring your personal data.

8.2. Data Retention – We will retain your Personal Data for as long as we deem necessary or appropriate, including to comply with Data Protection Legislation, resolve disputes and enforce our agreements. If you wish to receive marketing communications, we will keep the information necessary to send you these communications following the end of our customer relationship or following their collection, if you are a prospective customer. 8.3. How We Protect Personal Data – The security of your Personal Data is important to us. We follow generally accepted industry standards to protect the Personal Data submitted to us, both during transmission and once we receive it. Our Services use appropriate technical and organizational security measures to protect your Personal Data. The measures used are designed to provide a level of security appropriate to the risk of unauthorized or unlawful processing of your Personal Data. Unfortunately, the transmission of Personal Data via the internet is not completely secure. Although we will do our best to protect your Personal Data, we cannot guarantee the security of your Personal Data transmitted to us through our Services.  Any transmission is at your own risk.  Once we have received your Personal Data, we will use strict procedures and security features to try to prevent unauthorized access. Please note that no website or online service can ever be guaranteed as 100% secure and you should take reasonable precautions to protect your Personal Data (for example, by sharing Personal Data only with operators of websites and other digital platforms that you trust, by keeping any login details secure and confidential and by using antivirus software on your devices).

8.4. Links to Other Websites – our website may provide links to other websites for your convenience and information. These websites may operate independently from us. Linked sites may have their own privacy notices or policies, which we strongly suggest you review if you visit any linked websites. To the extent any linked websites you visit are not owned or controlled by us, we are not responsible for the sites’ content, any use of the sites, or the privacy practices of the sites.

8.5. Cookies – We use cookies on our website to improve your experience on the platform DEGA LMS; cookies are necessary.

8.6. Updates to Our Privacy Policy – this Privacy Policy may be updated periodically to reflect changes in our privacy practices.
